Council to appeal over ticket ruling

as reported in the Daily Post 29th August

 

 

LIVERPOOL City Council is considering a high court appeal to a ruling which could mean hundreds of parking tickets are invalid.

On August 2, a judge ruled that tickets issued by wardens across the country, including Liverpool, did not carry the correct information and should be annulled.

Liverpool city councillor Steve Radford then said parking fines given out to motorists could be invalid after the landmark court case in London.

Cllr Radford urged drivers given tickets by Liverpool traffic wardens since August 2 to appeal, although Liverpool has not changed the wording of tickets to comply with the court ruling.

Last night, Liverpool City Council chief executive Colin Hilton told Cllr Radford that the decision may now be challenged in the Court of Appeal.

Campaigners believe drivers who received penalty notices after the court's verdict should not have to pay them.

 

Last week, Liverpool council changed the type of ticket it uses to comply with the judge's ruling.

 

Neil Herron, who campaigns against parking regimes, said: "The judge said that every ticket requires a date of notice as well as a date and time of contravention. In Liverpool, the date of notice appeared separately on a tear-off slip.

 

 
 

 

 

"In effect, this means that any of these tickets issued after August 2 are annulled and people should not have to pay them."

Mr Hilton said he has asked the City Solicitor to provide information about the court ruling and the potential appeal.

Mr Hilton said: "The council would never knowingly ever pursue any unlawful action. We already fully comply with the requirements set down by the judge in his ruling."

Mr Hilton said there was no legal requirement to refund any penalty notices that had already been paid.

The court ruling in London involved a dispute between a motorist and Barnet council.

Cllr Radford said: "I believe this council is driving business away from the city by its enforcement policy. We should be encouraging people to enjoy the nightlife of the city, just like Manchester does with free on-street parking at night.

"The ruling as it stands is that tickets were wrongly issued and they should be cancelled."

Dear Editor,


I was confused by the letter from socialist Cllr Mumby (23/08/06), blaming the Liberal Democrats for the city’s housing problems.


While he is correct to point out the number of vacant properties and family’s on the waiting list has risen under the Lib Dems, he failed to point out the biggest contributing factor of the problem - the Labour Party’s policy to demolish thousands of houses in Princess Park, Kensington and Anfield.


With Labour cllrs remaining quiet on the demolitions which are forcing thousands of people onto the housing waiting list, it is the real Liberal Party who have been campaigning alongside local people to stop this policy of waste and expense.


The Liberal Democrats may as has he puts it ‘live in one city, the rest of us another’, however the cities where the Labour Party’s housing policy is more commonly found are Moscow, St. Petersburg and Leningrad.

"No more Flats plea" for Utting Avenue and Darmonds Green, Anfield

At the area Committee 24th August Liberal Party Cllr Steve Radford asked the committee to strongly oppose plans to build 7 flats on Utting Avenue. which would form an infill site amoungst an estate of established semi's.

He also asked them to oppose plans for 19 flats at the entrance to the Darmonds Green estate, Anfield 

"This perverse Lib Dem council is wasting millions of pounds demolishing terraced properties on the pretence of market failure but at the same time approving more and more flats when we know there is already an overwhelming excess", he asked councillors to look at New Road Court flats to see how companies like Barratt's produce shoddy and unstable developments and then walkaway thereafter

The objections also included concern at the implication of additional traffic entering heavily used arterial routes at both locations.

The Area committee supported Steve's objections which will be relayed to the Planning Committe who make the decision

Single Site for West Derby Boys School

The city council is working up plans for West Derby Boys school to be brought onto one site. This we agree with, however the current plan suggets putting both wings, plus the Ernest Cuckson Special School ,all onto the Bankfield playing fields next to the Peter Lloyd Leisure Centre

Liberal Party Councillors are keen to hear the vews of local residents, a real concern is that the narrow Bankfield Road is already heavily congested and the plan will create a traffic congestion nightmare

Planning Committte to consider Mens Hostel at      11 Green Lane, Tuebrook on Tuesday 2nd Sept.

Residents are welcome to attend the Planning Committee on 2nd September at the Town Hall, Dale Street from 13.00 hrs .

 The agenda has only a few items which include the application to demolish and rebuild the current Men's Hostel from its current capacity of 21 beds to a modernist building with 23 beds

If you can't attend why not drop a letter to The Liberal Party at 41 Sutton Street with your comments. We find it perverse to spend £2.2m to create only an additional two beds when there is a shortage of such accomodation in the order of hundreds of beds needed

Village Green Campaign takes stand in Edge Hill

Following Liberal Party members and residents working together to launch Village Green status applications for both the Dixie Dean Playing fields and Clubmoor Rec, the focus has now turned to the Tunnel Road fields which front the Chatsworth Housing Estate, in Edge Hill

Here local activist Pat Maddox was given the run around by council officials, however Pat knew she could depend upon the Liberal Party for support, Cllr Steve Radford accompanied her in presenting to the council the application and 9 witness statements.

This week the formal notices will appear in the Liverpool press for both the Tunnel Road and Clubmoor Rec applications 

The good news is ,as word travels, at least two more residents groups are meeting Liberal Party colleagues to assist launching more applications.

Village Green status requires that the land is open for common access (eg Not enclosed by fencing) and in common use without restrictions for a period of 25 years or more.

Each application needs to be presented to the Magistrates Court and have at least 6 witness statements confirming the common use for the 25 year period with a detailed map of the area in question.

Liberals Demand action over Housing Association vacants in Fairfield, Newsham Park ,Stoneycroft and Tuebrook

Dear Editor.

Further to your feature  "blight on our streets" (Men 21st July) where you expose the problem of Housing Associations leaving long term vacant properties which blight communities

We also have had this problem in Liverpool

In the case of the vacant property or properties being  owned by the local council ,then residents can write to the Secretary of State for Local Government who can in turn issue the council with what is known as a "prod notice"

However this remedy is not available when the vacants are owned by Housing Associations.

Having had the same problem in the Liverpool communities of Tuebrook, Newsham Park and Stoneycroft we have written to the Directors of the appropriate Housing Associations challenging their neglect

If this does not succeed then as at last resort residents  should write to the Housing Corporation
who finances and regulates Housing Associations.

Gladly often press coverage, such as given by the Manchester Evening news of recent, will often kick start the Housing Associations to act

Today Liberal Party members have expressed regret that the Liverpool Eil Cbal website has been closed down by internet operators. At the Clubmoor Area Committee meeting Cllr Steve Radford appealed for action by the council to secure with additional fencing at the rear of Muirhead Avenue Flats 55-101 due to the high leves of vandalism and breakins

At the Housing Committee Liberal Party Councillors Steve Radford, Chris Lenton and Hazel Williams have called for more robust fencing to secure the Brainerd Street / Lister Drive flats and at the same time are liasing with Police and the Anti Social Behaviour Unit over known families recently moved into the area causing untold  difficulties

Liberals Challenge £2.2million pounds to produce only two extra hostel beds in Green Lane Mens Direct Access

At the recent planning committee Cllr Steve Radford objected to the replacement of a stylised building at 11 Green Lane with a modernist building for a new mens direct hostel at 11 Green Lane. The new hostel would only increase capacity from 21 to 23 beds at a cost of £2.2m

Steve Radford suggested that the curent building be sold and a significantly larger building with extra capacity be built on a new site.

He also expressed concern a hostel for vulnerable men right by two junior schools was not the most appropriate location

The planning committee at Steve Radford's request have agreed to undertake a site visit before any decision

Housing Associations under pressure to sell Long term Vacant Houses

Liberal Party councillors have been writing persistently to Housing Associations bosses at Riverside and LHT concerning their land -banking long term vacant homes and causing blight in various communities

 After sustained lobbying 89 Moscow Drive a large three floor house is going up for sale along with a long term vacant at 6 Russian Drive, which was subject to a recent fire

Liberals support Progress on Alleygating Programme

The city council's housing and community safety committee discusssed the 2006/7 alleygating programme after it was called in by the Labour Party.

Liberal Party Councillor Steve Radford pointed out that every councillor had been circulated details of the prospective programme and amendments had been taken on board after input from councillors and police, therefore he was alarmed that Labour Councillors were in effect delaying alleygating of known hot spots.

Steve said that the programme included major crime hotspots in his Tuebrook and neighbouring Anfield and Clubmoor Wards

Sites scheuled for alleygating funds included:

Rear of Larkihill Shops / Larkhill Lane

Lindsay Road passageway to Sandeman Road

Passageway between Drummond Road and Utting Avenue

Passageway between Agar Road and Muirhead Avenue

Passageway Ferguson Road onto Queens Drive

Rear of 67 to 91 Sutton Street to secure new build flats

Entries running between Anfield Youth Club and Clarendon Rd, Claude Rd and Lampeter Road.

Passageway at end of Scorton Street, Morecambe Street, Rockhouse St, Rossett Street, Thurnham Street, Preston and Denton Groves

Passageway between Letchworth Street and Sedley Street

Judges Way , rear of Judges House, Newsham Park

The committee agreed to proceed with the programme and agreed to cirulate councillors for a list of outstanding locations to be actioned for2007/8, this was despite contributions by the Labour Spokesperson seeking to send the list again for consultation.

Residents in these and other areas will be consulted prior to the erection of any gates

Dear Editor

In many ways I would agree with Tony O'Hara when he points out the significance of a new enlarged stadium to benefit the city

Yes , without doubt the potential Speke site had far more advantages of rail and road links than the Stanley Park site.

However if there were a need to keep the stadium in the north city there are also sizeable areas of the East Lancs ,which would be preferable than congesting up Anfield even more so than currently

We do need an international  stadium
for LFC , that can be done without concreting Stanley Park

Despite endless council propaganda, over 400 hundred residents wrote in protesting at the portential loss of Stanley Park

If the scheme has popular support then where were the letters of support for Stanley Park to became just another building site

The Liberal Democrats promised to save our parks and their duplicity lies exposed, whether it be in Newsham Park , over Stanley Park or even the Dixie Dean Playing fields.

Demolition of 3,000 city homes gets the go-ahead
 

3,000 terraced houses are to be bulldozed as part of the biggest residential clearance programme for 40 years

LIVERPOOL'S plans to bulldoze 3,000 terraced houses as part of the biggest residential clearance programme for 40 years are back on track after the Government gave the go-ahead to the scheme.

Local Government Secretary of State Ruth Kelly yesterday lifted orders which prevented planning permission for the massive regeneration programme from going ahead.

Earlier this year, Liverpool City Council granted outline planning permission for the three Housing Market Renewal Initiative (HMRI) schemes at Anfield and Breckfield, Picton and Edge Hill.

Under the so-called Pathways regeneration strategy, 3,000 homes will be demolished and replaced by new homes

Mrs Kelly put the plans on hold in July while she sought more information from the council on design issues and affordability.

 

Now the council has been told that the Secretary of State has decided not to "call-in" the plans and the direction has been lifted.

The Government move comes as a public inquiry into compulsory purchase orders for around 1,000 homes in the four areas continues.

The council's Liberal Party Leader, Cllr Steve Radford, who is opposing the clearance programme, said: "While I'm disappointed the go-ahead has been given, the fight is not over yet.

"We have been fighting this scheme tooth and nail at the current public inquiry, which is now in its summing-up stages.

"The freezing of the plans by the secretary of state shows the council's total lack of detail, even though they have already moved two-thirds of the population out. It's about social cleansing rather than community regeneration.

"Pathways is really a house-crusher project. We need to keep our affordable housing, not get rid of it at enormous expense."

The city council insist that a housing strategy is vital to create sustainable communities by providing the types of houses that people want to live in, rather than attempt to refurbish unpopular small and worn-out terraced homes.

Following Mrs Kelly's decision, Cllr Marilyn Fielding, executive member for neighbourhoods and housing, said: "We were always confident that the proper planning procedures had been followed and that we could satisfy the points which had been raised on design and affordability.

"HMRI is about providing decent, affordable homes in areas where the housing market has collapsed and these plans will do that."

We would add to the balanced article written by the Daily Post that the ongoing Pubic Inquiry has yet to conclude and that this is the first of many expected anti-demoliton battles

The council policy is built upon an expectation to demolsh another three thousand homes over the next three years alone,.

Longer term they plan 12,000 demolitions.

If you live in a pre-1919 terraced home you should be protecting your home and communtiy by supporting Liberal Party Anti Demolition Candidates in the local elections

 It is vital your community stop to prevent the council and housing associations operating a policy of dereliction by stealth which is the forerunner of this demolition programme

We have been accursed of scaremongering, but on what grounds?

 

We have merely assisted local residents apply for Village Green Status for Clubmoor Rec

 

If the Labour Party were truly committed to protecting local open space they would be congratulating us

 

However let’s look at the factual record of Labour in Liverpool over the issue of protecting green and open spaces

 

1) Labour Councillors supported building both McDonalds and two community centres encroaching upon Clubmoor Rec

 

2) Labour Councillors voted for building on Stanley Park

 

3) Labour Councillors vote to build the new North City Academy on the Dixie Dean Fields rather than use current developed sites

 

4) Labour Councillors voted to build an Academy on Newsham Park

 

It is not a case of scaremongering but voting record

 

Labour  and Lib Democrats are equally callous about building on our Victorian Parks and Open Spaces.

 

Any other residents groups wishing to protect open spaces which have been established for over 20 years are welcome to write to us at the Liberal Party , 41 Sutton Street, Tuebrook.
